Frontiere geografiche e frontiere del diritto della migrazione: sempre più invalicabili?

Drawing on the European Court of Human Rights judgment in H.D. v. Italy (April 9, 2026), this article analyzes the gradual erosion of the protections afforded to migrants—and in particular to unaccompanied foreign minors—under Italian law. Recent security regulations and the implementation of the European Pact on Migration and Asylum, in effect since June 2026, reveal a trend that subordinates fundamental rights to the needs of security and administrative efficiency, in contrast to the principle of non-refoulementand the protection of vulnerable individuals.
