This essay aims to analyze studies on gender and sexuality by adopting a multidisciplinary approach, ranging from the sociology of law to European Union law. In particular, we will seek to understand to what extent and in what ways the philosophy of law has influenced studies on sexuality and gender, which are inevitably linked not only to areas of positive law, but also to disciplines such as biomedicine, ethics, anthropology, and sociology. Starting from Zygmunt Bauman’s analysis of “liquidity,” we will focus on Ken Plummer’s studies on “intimate citizenship” and Habermasian discourse ethics to understand how sociology and legal philosophy can intersect to give relevance to queer voices in our society. We will then focus on deconstructing legal subjectivity in the classical sense through the lens of critical legal studies and, in particular, queer theory. Finally, we will examine EU regulations and judgments of the Court of Justice of the European Union, which seem to offer prospects for the protection of queer minorities.
