Genealogical expressions give depth to a juridical textual system that is neither arbitrary nor totalitarian, nor solipsistically conforming to hegemonic techno-formal demands, but rather refers to the essential represented by logical-rational-relational functioning. The genealogical question, accompanied by a wealth of meaning, that is to say, by a commitment to transmission and hermeneutics, is based on the fact that the phenomenological structure of law emphasises its peculiarity by referring to humanitas. The meaning of the genealogical question motivates law, in its institution, within the rational limits of the civilisation of law. In order to explain legal anthropology, we proceed from the idea of the principle of genealogical causality. The essential terms can be traced back to a basic legal construction, which does not mean re-establishing or destroying in order to rebuild from scratch, but rather reappropriating the classical dimension of law. This refers to the dimension oriented towards legal communication, re-proposed in a specific genealogical architecture, in order to bring about the ‘sense of justice’ within the current regulatory framework, also shaped by the contemporary data civilisation that sets the scene for any reflection on law, expressed in the possible orientations of current juridical thought.
