The paper analyzes the evolution of the notary function in the era of digitalization and artificial intelligence, highlighting how technological innovation transforms operational tools without altering the nature of the notary’s public function. AI is considered a support for preparatory and organizational activities, but it cannot replace human judgment in verifying the will of the parties and monitoring legality. This perspective broadens, considering that technological progress must be measured with human dignity, justice, inclusion, and accountability, as religious rights suggest. The study delves into the role of the notary in the circulation of new forms of digital wealth, including digital works, dematerialized financial assets, cryptocurrencies, and NFTs, as well as in digital estate and e-legacy planning. In this scenario, the notary assumes a central function of guarantee, transparency, and accountability, ensuring legal certainty, personal protection, and reliability of asset transfers even in the context of emerging technologies.
