The advanced globalization of contemporary societies, accompanied by unprecedented global migration dynamics, heightens the need to clarify the legal framework for migrants’ access to essential state services, including healthcare. Despite being a fundamental right, migrants’ right to healthcare faces several obstacles, such as a lack of clear information and cultural and linguistic differences that complicate the understanding of contracts and regulations: from informed consent for medical procedures to forms for the processing of personal data, from information on patient rights to declarations of intent regarding treatments and therapies. This article, after a brief introduction to national and international regulations regarding migrant healthcare, analyzes the factors that hinder full direct access and possible corrective processes. It then focuses on the issue of migrants “in transit” and the cooperation between Italy and Albania, recently the subject of heated international debate following the enactment of Law 14/2024. The article aims to provide scholars and professionals with food for thought and insights into the various sociological and regulatory dimensions of health issues from a migration perspective.
