The relationship between language and law is essential to ensure clarity, knowability and effectiveness of legal norms. The use of simple and accessible language, as in the 1948 Italian Constitution, ensures democratic participation and legal certainty. Regulatory complexity, on the other hand, compromises citizens’ understanding, undermining the principle of legality. Initiatives such as the Tuscan Law on Regulatory Quality and recent Constitutional Court jurisprudence underscore the importance of clear regulation. Similarly, in contracts, especially mass legal transactions, clarity and comprehensibility have become fundamental obligations, protecting contractual freedom and consumer rights, pushing toward a general principle of transparency even beyond consumer law.
